Blizzard sues Peons4Hire - on what grounds?

Blizzard/Vivendi have apparently filed suit against a Chinese company, Peons4Hire. They're asking the court to grant injunctive relief to prevent P4H from spamming in-game (typical practice is to create level 1 characters using free sample accounts, run them to a capital city, and whisper 'Cheap Gold peons4hire.com' to whoever they can before their account is banned; they also send in-game mails).

What I'm trying to figure out is: what is the claim? What exactly would Blizzard allege P4H were doing wrong?

Damages for breach of contract? Can you get injunctive relief to prevent someone from entering into a new contract (the ToS) with the intention of breaching it immediately? Based on past behaviour? Proving breach of the terms of service would appear to be the easiest course of action.

Tortious interference with contract? Or interference with property? What about spam laws? Does this behaviour fall under the definition of spam? In-game whispers aren't the same as emails, there's got to be exceptions for receiving unsolicited whispers, otherwise the game wouldn't work. On the other hand, this reasoning would only apply to non-commercial unsolicited whispers.

There can't be copyright infringement - as soon as the licence to use is terminated, so is the account. A new licence is entered into as soon as they create a new (legitimate) account, and the game isn't used in between. I'd hate to have to prove that they didn't delete and reinstall each time, there's just no evidence.

The best I can see is damages for breach of contract. Not sure how they'd get an injunction out of that though.

This doesn't even consider the jurisdictional issues.

This is difficult - if anyone has seen the claim, I'd very much appreciate a copy.

Edit: anyone know of examples where a person has been prevented from entering into future contracts with a particular party on the basis that it tends to breach those contracts?
